1. Contracting Parties

This Distance Sales Contract is concluded between:

– hereinafter referred to as “Seller” –

and

The customer placing an order via the online shop

– hereinafter referred to as “Customer”.

A consumer within the meaning of Section 13 BGB is any natural person acting outside their trade or professional activity.

2. Subject Matter of the Contract

The subject of this contract is the sale of jewelry products (including but not limited to necklaces, bracelets, rings, earrings, and personalized jewelry) via the Seller’s online shop at www.lumiere-jewellery.de .

Product descriptions, materials, sizes, and prices are displayed on the respective product page.

Minor deviations in color or appearance due to screen settings or handcrafted nature shall not constitute defects.

3. Conclusion of Contract

The product presentation in the online shop is not a binding offer.

By clicking the “Buy Now” button, the Customer submits a binding offer.

The contract is concluded upon confirmation by email.

4. Prices and Shipping

All prices are in Euro (€) and include statutory VAT.

Shipping costs are shown during checkout.

For international deliveries, customs duties or import taxes may apply and are borne by the Customer.

5. Payment

Accepted payment methods:

• Credit Card

• PayPal

• Klarna

• Bank Transfer

Payment is due immediately unless otherwise agreed.

6. Delivery

Delivery is made to the address specified by the Customer.

Estimated delivery time: [2–7 business days].

Risk of accidental loss transfers to the Customer upon delivery.

7. Retention of Title

Goods remain the property of the Seller until full payment is received.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days.

The withdrawal period is 14 days from the day the Customer receives the goods.

9. Exclusion of Withdrawal (Important for Jewelry)

The right of withdrawal does NOT apply to:

• Personalized or custom-made jewelry (e.g., engraved items, custom sizes)

• Earrings or piercing jewelry if the hygiene seal has been removed

• Goods made to the Customer’s specifications

• Sealed goods not suitable for return due to health or hygiene reasons once unsealed

10. Effects of Withdrawal

If the Customer withdraws:

• Payments including standard shipping will be refunded within 14 days.

• The Seller may withhold refund until goods are returned.

• The Customer bears return shipping costs unless defective.

Returned jewelry must be:

• Unworn

• Undamaged

• In original packaging

If the product shows signs of wear, scratches, or damage beyond inspection, compensation for diminished value may be claimed under §357 BGB.

11. Jewelry Care & Liability Disclaimer

Jewelry may naturally oxidize or tarnish depending on skin type, humidity, perfumes, cosmetics, or water exposure.

The Seller is not liable for:

• Tarnishing due to improper care

• Damage caused by water, chemicals, or mechanical force

• Allergic reactions unless caused by legally non-compliant materials

Customers are responsible for proper care according to provided care instructions.

12. Warranty

Statutory warranty rights under German law apply.

The warranty does not cover:

• Normal wear and tear

• Scratches due to daily use

• Damage caused by improper handling

13. Limitation of Liability

The Seller is fully liable for intent and gross negligence and for damages resulting from injury to life, body, or health.

Otherwise, liability is limited to the extent permitted by German law.

14. Applicable Law

German law applies, excluding CISG (UN Sales Convention).

15. Online Dispute Resolution

The European Commission provides an ODR platform:

The Seller is not obligated to participate in arbitration unless legally required.
